Through this law, the territorial area of Sines, served by the National Electricity Transmission Network associated with the current Sines substation, was recognized as an area of high demand and, as such, subject to the exceptional procedure provided for therein (cf. article 20(1) of Decree-Law 80/2023). In this context, Announcement no. 184-A/2023 was subsequently published in the Diário da República on September 12, which made public the opening of the first phase of the exceptional procedure for allocating consumption capacity in the Sines High Demand Zone, and more recently Directive no. 20-A/2023, of December 29, of the Energy Services Regulatory Authority (ERSE), which approves regulations on the allocation of connection capacity to the network for consumption facilities in the Sines High Demand Zone.
Pursuant to Article 3(1) of Decree-Law 80/2023, this exceptional procedure comprises the following potential phases: (i) expression of interest and determination of unused capacity; (ii) provision of a security deposit; (iii) determination of demand; (iv) provision and assignment of capacity and assessment of demand; and (v) auction for the allocation of available capacity.
Following confirmation of the terms of the demand requested by the interested parties who submitted expressions of interest within the scope of this procedure, it was found that the capacity to be made available as a result of network reinforcements is insufficient to meet the terms of the confirmed demand requested, which is why the phase of making available and transferring unused capacity is opened, as provided for in article 8(1) of DL 80/2023.
In compliance with article 2(11) of ERSE Directive 20-A/2023 of December 29, the unused allocated capacity for installations with an assigned connection to the National Distribution Network, amounting to 163,28 MVA, is disclosed.
